TradeWork Services Customer Terms & Conditions

TradeWork will be there every step of the way when it comes to completing your electrcial home project.

 


Scope Of Work

TradeWork shall provide labor and material to specified home projects listed within written agreement in order to complete services agreed upon with owner. 


Estimates

Estimate details are subject to reasonable pricing/adjustments throughout the installation process. Install/pricing adjustments will be made known to the customer before adjustment is installed/altered. Remote estimate are not exact prices and are subject to field approval. Adjustments to estimates are done by TradeWork management only.


Time Of Completion

TradeWork shall start and complete service project as outlined in project agreement. If reasonably unforeseen obstacles obstruct original project timeline. Then TradeWork has the ability to adjust start/completion dates and/or pricing of original agreement in order to complete the original agreed project result. 

 


Warranty

Project agreements completed by TradeWork Home Services shall be covered by a lifetime workmanship guarantee. Workmanship is defined by maintaining Industry/TradeWork standard installation/Labor practices. TradeWork shall remain the sole warranty station of agreed project warranty. Third party personal working on TradeWork warrantied projects without written approval from TradeWork management will result in termination of warranty. Product failures within 90 days of install are covered under workmanship warranty. Product failures after 90 days are not covered under workmanship warranty and may result in additional purchases in order to remain safety code compliant. Manufacturer warranties will be processed by customer. Customer supplied product failures will not be covered under TradeWork workmanship warranty. Contacting TradeWork under the guise of warranty must fall under the original scope of the original project agreement. At the TradeManager’s discretion, If service call does not result within warranty, then the customer will be liable by either payment compensation for service call or if payment is not taking then a verbal warning of warranty misuse shall be issued. Repeated/negligent misuse of warranty could result in warranty being discontinued. Failure to abide by standards specified will result in warranty becoming deactivated until recommended fix/repairs to done to acceptable standards listed. 

 


Payments

Final payment will be required to be issued after service is complete to industry/written agreement standards unless a project money deposit is required within written agreement. Project money deposits will be paid within the agreed upon time before work will begin. Payment can be made in U.S. currency and all payments will be issued to TradeWork Home Services. Failure to make project deposit payment may result in termination of original agreement. Failure to provide complete payment will result in breach of contract and may cancel agreement and/or seek legal remedies.

 


Permits

State/Federal required permitting and regulatory approvals will be obtained by TradeWork Home Services unless written agreement is authorized by TradeWork management. TradeWork Contractors shall comply with all requirements listed. Failure to have TradeWork obtain state/Federal permitting will result in liability of home project to be on permit holder. The cost for permitting/regulatory approvals will be part of the payment to TradeWork Home Services under the agreement.

 


Final Inspections And Liens

Upon notification by the TradeWork contractor of project agreement completion, the owner and the TradeWork manager shall each sign their approval of satisfactory workmanship and material installation. When both the owner and TradeWork Manager find the work is completed, the owner shall pay the contractor any balance of the payments to TradeWork Home Services. Upon receiving the payments, TradeWork Home Services shall deliver the owner a release of all liens. Owner will make work area accessible for any workmanship inspections that are required by TradeWork Home Services and/or the State.

 


Insurance

TradeWork and all Contractors associated with agreement shall maintain adequate General Liability, Professional Liability, and any state mandated employee insurance coverages. All Insurances listed shall be maintained as long as professional business is operating. 

 


Survey and Title

The owner will indicate the property lines to TradeWork Home Services and will provide adequate boundary markers by a licensed land surveyor if the owners in doubt about the property boundaries. A state sponsored excavation survey shall be completed by owner to ensure utilities and any underground obstructions are properly marked by qualified personal. 

 


Access 

The owner will allow free access to work areas for workers and vehicles and will allow areas for the storage of materials and debris. Driveways will be kept clear for the movement of vehicles during work hours. The TradeWork contractors will make reasonable efforts to protect driveways, lawns, shrubs, and other vegetation. 

 


Project Work Area and Obstacles

Owner is responsible for clearing work areas of any debris that will inhibit service productivity. Failure to clear work areas and/or remove obstacles may result in additional charges to original project agreement. Debris left by owner in work areas will be left undisturbed by contractor and owner will be notified to relocated work area obstacle. Once notified if owner decides to continue to leave obstacle in work area, then TradeWork is no longer responsible for any damages.

 


Home Responsibility

The contractor nor recipient are not responsible for any damages, theft, or otherwise improper action due to the absence of property owner. Security of property is the sole responsibility of property owner and not to be placed as a responsibility onto the contractor nor TradeWork Home Services. 

 


Completion Of Service

Upon the completion of the agreed services between owner and TradeWork Home Services, the TradeWork Contractor shall see to it that the owner’s property is restored to a reasonable condition that the home was in prior to the entry of the TradeWork contractor. The TradeWork contractor shall see to it that all portions of work areas during the term of this agreement shall be broom cleaned and free of project debris. Debris left by owner in work areas will be left undisturbed by contractor as best as reasonably possible.

 


Default

The occurrence of any of the following shall constitute a material default under this agreement: 

a.    The failure to make a required payment when due.
b.    The insolvency or bankruptcy of either party.
c.    The subjection of any of either party’s property to any levy, seizure, general assignment for the benefit of creditor, application, or sale for or by any creditor or government agency.
d.    The failure to make available or deliver the services in the time and manner provided for in the agreement.



Remedies

In addition to any and all other rights a party may have available according to law, if a party defaults by failing to substantially perform any provision, term or condition of this agreement (including without limitation the failure to make a monetary payment when due), the other party may terminate the agreement by providing written notice to the defaulting party. This notice shall describe with sufficient detail the nature of the default. The party receiving such notice shall have 5 business days to respond to notice and 15 days from the effective date of such notice to have an agreed cure for default(s) with timeline of remedy completion. Unless waived by a party providing written notice. If agreed cure is not followed by either party, the defaulting party will automatically terminate agreement.

 


Severability

If any provision of this agreement will be held to be invalid or unenforceable for any reason, the remaining provisions will continue to be valid and enforceable. If a court finds that any provision of this agreement is invalid or unenforceable, but that by limiting such provision will be deemed to be written, construed, and enforced as so limited. 

 


Agreement Obligation And Amendment

Agreement is legal between both parties as it is signed by each party or enough reasonable evidence is presented to represent the obligated parties’ consent. Agreement may be modified or amended if the writing is signed by party obligated under the amendment or if enough reasonable evidence is presented to represent the obligated parties’ consent.

 


Governing Law

This agreement shall be construed in accordance with the laws of any operating State/Federal regulation(s) that TradeWork Home Services operates in.

 


Notice

Any notice or communication required or permitted under this agreement shall be sufficiently given if delivered in person or by certified mail, return receipt requested, to the address set forth in the opening paragraph or to such other address as one party may have furnished to the other in writing.

 


Waiver of Contractual Right

The Failure of either party to enforce any provision of this agreement shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of this agreement.
